This policy describes the types of information we may collect from you or that you may provide when you visit our website via https://www.yogawell.com/, use our mobile application (the “App”) available on the Apple App Store and Google Play Store, and/or our affiliated online platforms (hereinafter collectively referred to as our “Website“) and our practices for collecting, using, maintaining, protecting, and disclosing that information.

Information that you provide (including name, email, address, etc.) by filling in forms on our Website or App. This includes information provided at the time of subscribing to our e-mail lists, requesting further content and/or services, or registering for or logging into an account. We may also ask you for information when you enter a contest or promotion sponsored by us, and when you report a problem with our Website or App. Behavior on emails sent to customers who request information through the Website including: open rate, click through rate, etc. Records and copies of your correspondence (including email addresses), if you contact us. Payment card details are processed directly by our payment processor(s), which may include Apple or Google if a purchase is made through the App; we do not store full payment card numbers on our own servers.

Participants in our classes may provide information to be published or displayed (hereinafter, “posted“) on private collaboration areas of the Website, or transmitted to other users of the Website or third parties (collectively, “User Contributions“). Your User Contributions are posted on and transmitted to others at your own risk. Although we limit access to participants enrolled in our classes, please be aware that no security measures are perfect or impenetrable. Additionally, we cannot control the actions of other users of the Website with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies:

As you navigate through and interact with our Website or App, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

Details of your visits to our Website or App, including traffic data, location data, logs, and other communication data and the resources that you access and use. Information about your device and internet connection, including your IP address, device model, operating system and version, unique device identifiers, and browser type (as applicable). Details regarding advertising you clicked on, including GA Client ID, GCLID, Facebook fbc, and Facebook fbp A device token or similar identifier used to deliver push notifications to the App, if you have enabled push notifications.

The information we collect automatically may include personal information, or we may maintain it or associate it with personal information we collect in other ways or receive from third parties. It helps us to improve our Website and App and to deliver a better and more personalized service, including by enabling us to:

Estimate our audience size and usage patterns. Store information about your preferences, allowing us to customize our Website and App according to your individual interests. Recognize when users return to the Website or App.

The technologies we use for this automatic data collection may include:

Cookies (or browser cookies): A cookie is a small file placed on the hard drive of your computer. You may refuse to accept browser cookies by activating the appropriate setting on your browser or refusing cookies when prompted by the Website. However, if you select this setting you may be unable to access certain parts of our Website. Unless you have adjusted your browser setting so that it will refuse cookies, our system will issue cookies when you direct your browser to our Website.

Web Beacons: Pages of the Website and our e-mails may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags, and single-pixel gifs) that permit the Company, for example, to count users who have visited those pages or opened an email and for other related website statistics (for example, recording the popularity of certain website content and verifying system and server integrity).

Mobile Device Identifiers: 

Our App may use device identifiers and similar tools provided by our App platform provider, Kajabi, to help the App function, remember your login, and understand how the App is used.

Push Notifications:

If you enable push notifications on your device, we (and/or Kajabi on our behalf) may send you notifications about course updates, new content, reminders, or other information related to your account. You can opt out of receiving push notifications at any time by adjusting the settings on your mobile device (typically under Settings > Notifications for the App). Opting out of push notifications does not affect other communications you may receive from us, such as email.

We do not request or access your camera, photo library, microphone, contacts, or location through the App at this time. If that changes in the future, we will update this policy and, where required, ask for your permission before accessing that information.

Our App and Kajabi Our mobile App is built and hosted on the Kajabi platform. When you use the App, certain information described in this policy (such as your account information, course activity, and device information) is processed by Kajabi, Inc. on our behalf as our service provider, in order to operate the App, deliver course content, and support features like login and push notifications. We do not control, and are not responsible for, the practices of Apple or Google as the operators of the App Store and Google Play Store, including how they collect information related to app downloads or in-app purchases; please review Apple’s and Google’s own privacy policies for more information about their practices.

Within the App itself, the information collected is limited to your email address and a user ID, which are used to identify your account and grant you access to your course content, together with product interaction data, crash data, and other diagnostic data used to operate, maintain, and improve the App. This information is linked to your identity but is never used to track you across other companies’ apps or websites for advertising purposes. Additional profile information, such as your name, is collected and stored through your Yoga Well Institute website account and is not separately collected within the App.

How We Use Your Information: The information you provide is stored in our CRM, App, and course platform (Kajabi), and our form software (Typeform or WPForms). 

We use information that we collect about you or that you provide to us, including any personal information:

To present our Website and App and their contents to you. To create, maintain, and secure your account, and to provide you with the content, products, newsletters, or services you request from us, including course access. This includes sending on average weekly newsletters that may include: blog articles, information about offerings, and more. To fulfill any other purpose for which you provide it. To create “lookalike” audiences for advertising To provide you with notices about your account/subscription, including expiration and renewal notices. To carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection. To notify you about changes to our Website or App or any products or services we offer or provide through them, including via push notification. To allow you to participate in interactive features on our Website or App. To operate, maintain, and improve the App, including diagnosing technical issues. In any other way we may describe when you provide the information. For any other purpose with your consent.

We may also use your information to market current and future offerings that may be of interest to you. If you do not want us to use your information in this way, please use the Unsubscribe links at the bottom of e-mails you receive from us, adjust your notification settings, or contact us via the e-mail or phone number posted on this website. Alternatively, some correspondence will give you the opportunity to opt out of that campaign, but remain on our mailing list for more suitable communications.

Participants in our online classes should be aware that video recordings from our classes may be shared with the public on social media for publicity purposes. This use is covered by our Publicity Waiver and Release agreement with class participants.

Disclosure of Your Information:

We do not rent or sell information for marketing purposes and we will never share or sell personal information of our users with third parties for marketing purposes.

We may disclose aggregated information about our users, and information that does not identify any individual, without restriction.

We may disclose personal information that we collect or you provide as described in this privacy policy:

To our subsidiaries and affiliates including: Kajabi for operations related to our Website, Online Student Portal, and App, including account management, course delivery, and push notifications, Facebook for effective advertising, Apple and/or Google, solely as necessary to distribute the App and, where applicable, to process in-app purchases, contractors, service providers, and other third parties we use to support our business, and for any other purpose disclosed by us when you provide information.

We may also disclose your personal information:

To comply with any court order, law, or legal process, including to respond to any government or regulatory request. If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of Yoga Well LLC, our customers, or others.

Choices About How We Use and Disclose Your Information:

We strive to provide you with choices regarding the personal information you provide to us. We have created mechanisms to provide you with the following control over your information:

Tracking Technologies:
You can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. When you navigate to the Website, you will be prompted to determine your Cookie tracking preferences.

Push Notifications:
You can enable or disable push notifications for the App at any time in your device’s settings, as described above.

Promotional Offers from the Company:
If you do not wish to have your email address/contact information used by the Company to promote our own or third parties’ products or services, you can opt-out by or sending an email stating your request to [email protected].

If we have sent you a promotional email, you may opt out by using the Unsubscribe links at the bottom of the message. This opt out does not apply to information provided to the Company as a result of a product purchase, warranty registration, product service experience or other transactions.

Accessing, Correcting, and Deleting Your Information You can review and change your personal information at any time by contacting us via the email address or phone number provided on our website, or by managing your account settings within the App or Online Portal, where available.

You may request to see what data we have about you, if any. 

You may change/correct any data we have about you, have us delete any data we have about you, including requesting deletion of your account and express any concern you have about our use of your data.

To request deletion of your account and personal data, please email [email protected] with the subject line “Account Deletion Request.” We will process your request within a reasonable time, except that we may retain certain information as required by law, to resolve disputes, enforce our agreements, or for legitimate business purposes such as financial recordkeeping.

Your California Privacy Rights California Civil Code Section § 1798.83 permits users of our Website that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our Website, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your personal information, we cannot guarantee the security of your personal information transmitted to our Website or App. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Website or App.

Changes to Our Privacy Policy:

It is our policy to post any changes we make to our privacy policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you by email to the primary email address specified in your account, and/or by an in-app or push notification, where appropriate.
